Terms of Service

Acceptance of terms
These Terms of Service (“Terms”) form a binding agreement between you and Pugilist Group Ltd, a company registered in England and Wales (company number 17122596), with registered office at 8 Blenheim Crescent, Leamington Spa, England, CV31 1FW (“PugiList”, “we”, “us”).
By creating an account on PugiList you agree to be bound by these Terms. If you do not agree, do not create an account or use the service.
Business-to-business contract. PugiList is provided to amateur boxing clubs as a professional tool. You contract with us as a business, acting in the course of your trade as a club, charity, or unincorporated association. Provisions of UK consumer law (including the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013) apply only where you are deemed a “consumer” in law and cannot be excluded; we have nevertheless extended the cooling-off right described below to new subscribers as a matter of policy.
These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, without prejudice to any mandatory statutory consumer rights you may have under the law of your country of residence.
The service
PugiList is a professional boxing matchmaking platform that helps amateur boxing coaches find eligible opponents, manage boxer rosters, organise shows, and coordinate sparring sessions within the England Boxing community.
The service is accessible via the website at pugilist.io and the PugiList mobile applications for iOS and Android.
The service is provided on a subscription basis. Features available to you depend on your subscription plan.
Eligibility
To use PugiList you must:
- Be a coach, club administrator, or authorised representative of an amateur boxing club
- Be at least 18 years of age
- Have the authority to enter into these Terms on behalf of your club
PugiList is not intended for use by members of the general public, athletes directly, or professional boxing organisations.
Club verification
New clubs must be verified by a PugiList administrator before accessing matchmaking features. Verification is at PugiList's discretion and may be revoked if a club breaches these Terms or England Boxing conduct requirements.
Boxer data and consent
You are responsible for all boxer data you enter into PugiList. By adding a boxer record you confirm that:
- You have obtained appropriate consent from the boxer (and their legal guardian if under 18) to store their personal data on the platform
- The data you enter is accurate to the best of your knowledge
- You will delete boxer records when a boxer is no longer affiliated with your club
PugiList acts as a data processor for boxer records on your behalf. You remain the data controller for boxer data and are responsible for compliance with UK GDPR.
Subscriptions and billing
PugiList offers two subscription plans, each available on a monthly or annual billing cycle. Monthly subscriptions are charged once per calendar month; annual subscriptions are charged once per year.
- Subscriptions are billed in advance for the billing cycle you choose (monthly or annual)
- Prices are exclusive of VAT. VAT will be added at the applicable rate where required by law
- Auto-renewal: subscriptions renew automatically at the end of each billing cycle at the then-current price unless cancelled. We will send a reminder email before each annual renewal
- You may cancel at any time via the billing portal in Settings > Billing. Cancellation takes effect at the end of the current billing cycle; your access continues until that date
- Outside the cooling-off period below, we do not issue partial-period refunds for early cancellation
- If your payment fails, we will retry collection and notify you. Access to paid features may be restricted until payment is resolved
- All subscriptions are taken directly by Pugilist Group Ltd via Stripe through the PugiList website at pugilist.io. The PugiList mobile applications do not offer in-app purchases or in-app subscription sign-ups, and we do not use Apple In-App Purchase or Google Play Billing
14-day cooling-off right: If you are a new subscriber and have not yet used the paid features of the service, you may cancel within 14 days of first purchase and receive a full refund. If you begin using paid features within that period, you acknowledge that the service has started and you waive the statutory cancellation right in respect of the portion of the service already supplied, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Refunds and chargebacks
Refunds. Outside the 14-day cooling-off right, refunds are issued only in the following circumstances:
- A material change to these Terms with which you do not agree (pro-rata refund of the unused portion of the prepaid period)
- An extended service outage beyond our 99% monthly uptime target, on written request
- A demonstrable billing error on our part
- Where we are required by law to issue a refund
We do not issue partial-period refunds for early voluntary cancellation, account closure following a breach of these Terms, or because a feature you do not use is not available on your plan. Approved refunds are returned to the original payment method via Stripe and may take 5 to 10 business days to appear on your statement.
Disputes: please contact us first. If you believe a charge is incorrect, please email support@pugilist.io before raising a chargeback with your bank. We will respond within 5 business days and aim to resolve billing disputes within 14 days.
Chargebacks. If you initiate a chargeback or payment dispute through your bank or card issuer in respect of a charge that we believe to be valid, we may:
- Suspend your account and access to the service while the dispute is investigated
- Provide evidence of the charge to Stripe and your card issuer to defend the dispute
- Recover any chargeback or representment fees imposed on us by Stripe (currently up to GBP 15 per dispute) from you as a debt
- Terminate your account if the chargeback is found to be unjustified or fraudulent
Card-network and consumer protection rules give you the right to dispute charges directly with your bank and these terms do not seek to remove that right; we ask only that you raise the issue with us first where the dispute is genuinely about service or billing rather than fraud.
Acceptable use
You must not:
- Enter false, inaccurate, or fabricated boxer records, or impersonate another club, coach, or boxer
- Use PugiList to facilitate professional boxing or any unlicensed contests
- Attempt to circumvent, manipulate, or interfere with the England Boxing eligibility criteria applied by the platform, including the 28-day rest rule, weight tolerances, suspension enforcement, or medical-certificate gating
- Use chat, messaging, or any other communication feature to harass, intimidate, threaten, sexually solicit, defame, or otherwise harm any person; transmit hateful, discriminatory, or unlawful content; or share content that is sexually explicit, violent beyond the context of the sport, or otherwise inappropriate
- Use the platform in any way that endangers the welfare of a child or vulnerable adult, or that breaches any safeguarding obligation
- Reverse-engineer, decompile, scrape, mirror, or extract any data from the platform other than your own data via the export tools we provide
- Use the platform's data, content, or any output of the matchmaking engine to train artificial-intelligence or machine-learning models, or to produce derivative datasets for resale or redistribution
- Use the platform to send unsolicited marketing, spam, or any communication that breaches the Privacy and Electronic Communications Regulations
- Share your account credentials with unauthorised parties; you are responsible for all activity under your account
- Use the platform in violation of England Boxing rules, any applicable law, or any export-control or sanctions regime
- Resell, sublicense, or otherwise commercially exploit the service or your account other than for the legitimate operation of your club
Moderation and reporting. Any user may report a chat message, boxer record, or other content using the in-platform reporting tools. We will review reports promptly. We may remove content, restrict access to a feature, or suspend an account where, in our reasonable judgement, these Terms or applicable law have been breached. Where we suspend an account we will notify you by email, explain the reason where it is lawful and safe to do so, and give you a reasonable opportunity to respond before any decision is made permanent. Where the breach involves a credible safeguarding concern about a child, suspected criminal activity, or an immediate risk to a person, we may act without prior notice and report the matter to England Boxing, the police, or another competent authority.
PugiList reserves the right to suspend or terminate accounts that breach these Terms. Where termination follows a serious breach (including any breach involving safeguarding, fraud, or sanctions), no refund of prepaid fees will be due.
Matchmaking and match requests
PugiList surfaces opponent recommendations based on England Boxing eligibility criteria, specifically weight class, age band, and recorded bout experience. These recommendations indicate that a pairing meets the minimum criteria for a contest under England Boxing rules. They do not constitute professional advice and do not replace the coach’s independent judgment.
PugiList explicitly does not assess, and takes no responsibility for:
- A boxer’s current medical fitness or readiness to compete
- Recent injury, illness, or physical condition not recorded on the platform
- The quality, safety, or appropriateness of any individual bout
- The accuracy or completeness of boxer records entered by clubs
- Any outcome of a bout arranged via the platform (whether physical, competitive, or otherwise)
By sending a match request, the coach confirms they have independently assessed the proposed bout as appropriate for their boxer and accept full responsibility for that decision. PugiList is a facilitation tool only. The duty of care to each boxer rests entirely with their coach and club.
Accepting a match request reveals contact details to both clubs to allow them to arrange the bout directly. PugiList is not a party to any agreement between clubs and is not responsible for the conduct or outcome of any bouts arranged through the platform.
Intellectual property
PugiList and all associated software, design, and content are owned by PugiList. Your club name, boxer records, and bout history remain yours.
By using PugiList you grant us a limited licence to store, process, and display your data for the purpose of providing the service.
Disclaimers and limitation of liability
PugiList is provided “as is” without warranties of any kind. We do not warrant that the service will be uninterrupted, error-free, or that match suggestions will be optimal for every situation.
To the maximum extent permitted by law, PugiList shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including but not limited to outcomes of bouts arranged through the service.
Our total liability to you in any twelve-month period shall not exceed the total subscription fees you have paid to us in that period.
Termination and data return
You may close your account at any time from the account settings page. We may suspend or terminate your account where you breach these Terms, in accordance with the moderation and reporting process described above.
Before requesting deletion, you may export your data (your club record, boxer roster, bouts, match requests, and chat history) in a structured machine-readable JSON format from Settings > Export My Data. After termination we retain your data for 30 days as a grace period, then permanently delete it from our live systems and from backups on the next rolling backup cycle (currently within a further 30 days), except where longer retention is required by law (notably billing records, retained for 7 years) or anonymised retention is required for accountability (audit logs, retained for 24 months in pseudonymised form).
Mobile app: reader-only on iOS
The PugiList iOS application is provided as a reader application under Apple App Store Review Guideline 3.1.3(a). The iOS app does not offer in-app purchases, in-app subscription sign-ups, account creation for new clubs, or any payment user interface. Subscriptions and new-club registration are managed exclusively from the PugiList website at pugilist.io, where billing is processed by Stripe under Pugilist Group Ltd's Stripe account. The iOS app provides access only to previously-purchased content and existing club operations.
App Tracking Transparency. The PugiList iOS app does not track you across other apps or websites owned by other companies. We do not request the App Tracking Transparency permission and we do not use the IDFA (Identifier for Advertisers) for any purpose.
Permissions. The mobile app requests the following device permissions only when you opt to use the relevant feature:
- Notifications to deliver match-request alerts and chat notifications via Apple Push Notification Service or Firebase Cloud Messaging
- Camera and photo library to upload a club logo or boxer photo
- The app does not access your contacts, location, microphone, or any other sensor
App store legal terms (Apple App Store and Google Play)
These Terms apply to your use of the PugiList mobile app in addition to any store-specific terms that apply when you download the app.
Apple App Store:
- These Terms are between you and Pugilist Group Ltd only, and not with Apple Inc. Apple is not responsible for the app or its content
- Apple has no obligation whatsoever to provide maintenance or support for the app
- In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) paid to Apple. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app
- Pugilist Group Ltd, not Apple, is responsible for addressing any claims relating to the app, including product-liability, regulatory, or consumer-protection claims
- Pugilist Group Ltd, not Apple, is responsible for investigating and resolving any third-party intellectual property claim relating to the app
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary
- You represent that you are not located in a country that is subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and you are not listed on any U.S. Government list of prohibited or restricted parties
Google Play:
- These Terms are between you and Pugilist Group Ltd only, and not with Google LLC
- Google is not responsible for the app or for providing support in relation to it
- Your use of the app must comply with the Google Play Terms of Service in force at the time of use
Your indemnity to us
You agree to indemnify and hold Pugilist Group Ltd harmless from any third-party claim, loss, or liability (including reasonable legal fees) arising from:
- Boxer data you have entered that is inaccurate, fabricated, or entered without appropriate consent from the boxer (or their parent or guardian if under 18)
- Any breach by you of these Terms, England Boxing rules, or applicable law
- Any bout, sparring session, or activity arranged via the platform that results in injury, dispute, or regulatory action, to the extent the cause is outside PugiList's reasonable control
This indemnity does not limit any statutory rights you may have as a consumer.
Service availability
We aim for high availability of the service but do not guarantee uninterrupted operation. We target 99% monthly uptime measured across rolling 30-day periods, excluding scheduled maintenance and causes outside our reasonable control (upstream provider outages, force majeure). Scheduled maintenance will be announced in advance where practical and performed during off-peak hours.
Complaints
If you are unhappy with any aspect of the service, please contact us first at support@pugilist.io. We will acknowledge your complaint within 5 business days and provide a substantive response within 30 days.
For data-protection complaints you may additionally contact the Information Commissioner's Office (ICO) at ico.org.uk. For consumer disputes you may also use the online dispute resolution platform provided by the European Commission (while available to UK consumers).
Changes to these terms
We may update these Terms from time to time. Material changes will be communicated by email to active subscribers at least 14 days before taking effect. Continued use of the service after that date constitutes acceptance of the updated Terms. If you do not accept a material change you may cancel your subscription with effect from the date the change takes effect, and we will refund a pro-rata portion of any prepaid fees relating to the period after that date.
Force majeure
Neither party will be liable for any failure or delay in performance caused by events outside its reasonable control, including acts of God, war, terrorism, civil unrest, cyber-attack, pandemic, governmental order, failure of a third-party hosting provider or telecommunications network, or any other event of force majeure. The affected party will use reasonable efforts to mitigate the effect.
Notices
Legal notices to PugiList must be sent in writing to support@pugilist.io and to the registered office address above. Notices to you will be sent to the email address registered on your account; you are responsible for keeping that address current. Notices are deemed received on the next business day after sending.
Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to a successor entity in connection with a merger, reorganisation, or sale of substantially all of our assets, on no less favourable terms to you. We will notify you of any such assignment.
Severability and entire agreement
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision will be severed and the remaining provisions will continue in full force. A waiver by either party of any breach is not a waiver of any subsequent breach.
These Terms, together with the Privacy Policy and any plan-specific subscription terms presented at checkout, constitute the entire agreement between you and Pugilist Group Ltd in relation to the service and supersede any prior agreement on the same subject matter. No third party other than Apple Inc. (as a third-party beneficiary of the Apple App Store clauses above) has any right to enforce any provision of these Terms under the Contracts (Rights of Third Parties) Act 1999.
Sanctions and export controls
You represent and warrant that you, your club, and any individual you authorise to use your account (a) are not located in, organised under, or ordinarily resident in a country or territory subject to UK, EU, or US comprehensive sanctions, (b) are not listed on any UK, EU, or US sanctions or denied-parties list, and (c) will not use the service in breach of any applicable sanctions or export-control law.
